    How to declare the income from your rented property in Spain as a non-resident

    How is rental income taxed for non-residents (IRNR)?

    Non-residents who rent a property in Spain must declare the rental income through Modelo 210 (Non-Resident Income Tax - IRNR). The tax rate is 19% for EU/EEA residents and 24% for residents of other countries. This is a specific tax on capital property income generated in Spanish territory.

    An important advantage: EU/EEA residents can deduct expenses related to the rental (community fees, property tax, insurance, repairs, mortgage interest, depreciation). Non-EU residents are taxed on gross income without deductions. Example: rental €12,000/year, expenses €5,000 (EU): taxable base €7,000 × 19% = €1,330. Without deductions (non-EU): €12,000 × 24% = €2,880.

    Rental income is declared in the Modelo 210 covering the complete tax period (one calendar year). Since 2024, this declaration is annual and must be filed in January of the following year, not in quarterly installments as before.

    Filing deadlines

    Since 2024, rental declarations are annual and must be filed between January 1-20 of the following year (Order HAC/56/2024). For example, 2024 rental income is declared in January 2026. Previously, there were quarterly declarations which created more administrative complexity.
