Modelo 210 calculator: dividends, property and double tax treaties

When a Spanish company pays a dividend to a non-resident shareholder, the payer withholds 19% as a rule. But the double tax treaty between Spain and your country usually caps Spanish tax at a lower figure — typically 15%, 10% or 5%. The difference between what was withheld and that cap is reclaimed by filing a Modelo 210 refund return.
The same Modelo 210 covers income from your Spanish property: imputed income on an empty or personally used home (income type 02), rental income (type 01, or 35 when you group several payers) and the capital gain on a sale, with the buyer’s 3% withholding already credited.
This calculator follows the official mechanics of the return: tax under the Spanish non-resident income tax act, treaty limit, treaty reduction and withholdings already paid. The per-country caps come from Annex III of the Spanish Tax Agency’s non-resident taxation manual.
How to reclaim the excess withholding, step by step
- Collect the evidence. Ask your bank or broker for the withholding certificate showing the gross dividend, the accrual date and the tax withheld in Spain.
- Get a tax residence certificate. It must be issued by your own tax authority and state expressly that it is issued for the purposes of the treaty with Spain. It is valid for one year.
- Calculate the excess. Compare the 19% Spanish tax with the treaty cap. The difference is the treaty reduction and the amount to be refunded.
- File the Modelo 210. A refund return with income type 04 (dividends) and your bank account. You have four years from the end of the withholding filing period.
